Employers can continue to use the Most recent Form I-9 until May 31, 2027, US Citizenship and Immigration Services said last week, extending the document’s expiration date.
According to the agency, HR professionals should make sure they are using the form with an edit date of August 1, 2023. Forms that have just been downloaded will have the new date of expiration, but employers may, for the time being, continue to use any downloaded or printed form with the previous expiration date of July 31, 2026.
“Either form can be used until its respective expiration date,” USCIS said in a statement. Despite this, “[e]Employers are encouraged to update their electronic Forms I-9 systems to use the [2027] expiry date as soon as possible and must do so by July 31, 2026 at the latest,” he said.
Form I-9 is intended to verify a worker’s identity and eligibility to work in the U.S. All employers must have an I-9 form for each employeeand must be completed within a small window of the start date.
