The Supreme Court limits the scope of NEPA review in the decision of the Utah railway line

The environmental reviews of the federal agencies on the proposed projects should be “ a procedural cross review, not a substantial road blockade, ” the United States Supreme Court ruled in a May 29 decision, which will allow a Uinta Basin Railway project of $ 1.4 billion to advance to Utah. The ruling seems to limit the extent of the National Law of Environmental Policy, which requires that federal agencies prepare environmental impact statements for infrastructure projects.

The plan calls for the construction of an 88 -mile railway line that connects the Uinta basin rich in Utah oil on the national railway network to bring crude to the refineries.

The United States surface transport board, which determines whether to approve the construction of new railway lines, prepared an environmental impact statement that totalized more than 3,600 pages before passing the project by 2021.But a lower court eliminated approval after finding the review did not sufficiently consider the environmental effects of the activity that may be enabled on the construction of the railway, such as the increase in the drilling.

The Supreme Court reversed this decision 8-0. In the majority opinion, three judges agreed with the ruling, but they differ in their reasoning, Justice Brett Kavanaugh wrote that NEPA requires agencies to focus on the environmental effects of the project in question, but not other partially related environmental impacts.

“Deciding cases that involve the North -American economy, the courts should strive, whenever possible, due to clarity and predictability,” he wrote. “Some NEPA decisions of some courts have been reduced to this goal.”

The ruling comes when President Donald Trump has been pushing for ways to approve the approval of some projects, especially energy -related work. In response to an executive order issued by Trump, the United States Army Engineers identified hundreds of projects for quick monitoring through environmental reviews.

But the new ruling severely limits the extent of the NEPA by relieveing ​​federal agencies of the obligation to review all possible environmental damage related to a proposed project, according to the Earthjustice Environmental Defense Group. In this case, it means that agencies can ignore the environmental impacts on the communities of the Gulf Coast, where oil is expected to go to refineries.

“Today’s decision decades decades of legal precedents that told the federal agencies to look before jumping when projects that could hurt the communities and the environment,” said Sam Sankar, a senior vice president of Earthgustice programs, in a statement.

Advance the construction

With the favorable ruling, the Seven County Infrastructure Coallation, the public entity of the public-private collaboration behind the project, says he will work with the federal agencies to restore their approvals and move towards construction.

“This decision states the years of work and collaboration that have come to make the railway of the Uinta basin,” said Keith Heaton, director of the infrastructure coalition, in a statement. “It represents a turning point for rural Utah, with more safe, sustainable and more efficient transport options and opening new doors for investment and economic stability.”

The favored plan calls for a one -track route that would include the construction of 5.7 miles of tunnels, 30 railway bridges, a road bridge and 423 crops. It would connect to the National Rail Network through the Pacific Union subdivision, I try near Kyune, Utah.
