Do the offers protests offer a path around plas, but will a slow and steady precedent win the day?

Trump’s second administration has a problem with the mandate of Biden’s era that the project’s labor agreements establish the compensation and work rules on federal federal and federal projects, valued at $ 35 million or more.

A project work agreement is a pact between craft workers and contractors who establish standards for salary rates and the rules for the recruitment and resolution of disputes that defenders say that they offer a better cost and a forecast of the predictability and the ability to hire more qualified employees. Traditionally unions and federal owners, such as arrangements because they generally standardize the hard work of organizing jobs and contractor work for major government projects.

Opponents say that the plan can reduce competition and innovation tending to exclude non -union artisan workers, if their employers reject accepting payment fees or rules that require labor referrals through organized employment hiring rooms and allowing dues to finance political activity. The construction union adhesion rate reached a new minimum by 2023, according to the Office of Labor Statistics, of only 10.3% of the industry.

Officials who led the United States Department of Defense and General Services Administration told staff through memos that they would not require the use of plas. These memoirs were challenged by the North America’s construction unions, the umbrella group that represents 14 construction shops, which won a preliminary order in May to restore the mandate of the agreement.

The new administration is trying to avoid openly challenging organized work, rank and file, and some leaders, have supported President Trump and U.S. Work Secretary, Lori Chavez-Deremer, the latter endorsed by the union group.

But the administration also has a wide support of contracting business groups such as the general associated contractors of America and the construction group of the non -union majority, associated builders and contractors. The Plan debate puts the administration officials in the uncomfortable position of publicly supporting the labor mandate, as did the budget director of the Management Office in a June note, although he still tried to find a way around them.

Vought ordered the federal agencies to return the plan of the plan to their contracts, but also take advantage of the protest strategies for the offers that could cause the same result as in an AGC case in which a Judge of the Federal Claims Court eliminated the PFs’ pacts of the Army Corps’s PF engineers and other projects.

The GUM note calls on the federal agencies to maintain the requirements of the labor pact, but also indicates a provision of federal acquisition rules that provides an exception to the plan requirement for large construction projects when its use would substantially reduce the number of bidders and affect the price. But he has left neither contractor groups nor nabtu.

“To this point this is not what we expected, it is definitely better than what was in the administration of Biden,” said Brian Turmail, Vice President of Public Affairs and AGC work force. “In addition, given the recent judicial decisions, it is difficult to see how the administration will be able to impose a obligatory plan without successful supply protests.”

But the reasons to annul a mandate of the plan must not be based on the costs of the federal project, a recommendation of the federal recruitment rule or the agency’s memories. The ABC contractor group has quietly based its challenge on the mandate of the plan on the right of association of the first amendment outside Washington, DC, in a case presented by its Jacksonville chapter, FLA., ABC Florida First Coast Chapter and ABC National Vs. General Services Administration. Invokes a precedent for the 2018 case Janus vs. AFSCME, In Illinois School Professor Mark Janus successfully argued that his Union is in the American Federation of State County and municipal employees should not support their political activities or to risk violating their first right modification to freedom of expression to force these funds to use it to support the speech with which it is not agreed.

At the time, the President of Nabtu, Sean McGARCHE, openly said that collective bargaining costs were paid with member quotas and this is what made them necessary. “We just think it’s a terrible decision,” he said at the time. “There are real costs in the administration of collective bargaining and someone has to pay these costs, and there was a fair and equitable system established.”

McGavey stated that the first amendment was a “non-issuance”, but the majority ruling of the Supreme Court 5-4, which included the judge in any current John Roberts and the associate judges Clarence Thomas, Samuel Alito and Neil Gorsuch, said that Janus’s political rights were violated. This ABC argument strengthens that non -union contractors should not pay the union quotas to negotiate groups that neither benefit nor could generate a desirable result for them.

In a brief friend in the current challenge of the labor pact, the National Law Foundation to Legal Work, which was represented by Janus, wrote: “Under the rule of the plan in question, to work on federal construction projects valued to more than $ 35 million, non -union employees will have to accept the unwanted union representation; pay the union quotas in the rules of the right, union and union union; the compensation was diverted to the union pension plans of which they will not receive benefits. “

The language is so similar to the Janus argument that it could have been copied and stuck. The ABC case is now before the United States Appeal Court in Atlanta, and if this court agrees with the contractor group, a majority of the Supreme Court could reject any appeal even in the unlikely that GSA officials challenge the appeal court.

Offer protests could offer a short -term resolution to an administration to start a labor struggle, but it is difficult to see a Supreme Court with Roberts, Alito, Thomas and Gorsuch, which is now incorporated by associated justice Brett Kavanaugh with work on the subject, although the retired associate judge Anthony Kennedy joined the majority of Janus in 2018.

Even associated justice Amy Cope Barrett has been facing speech rights in similar cases.

A resolution related to Janus also offers a way to go for the shops of the building. 10.3% of the U.S. construction labor are still a considerable amount. Use these funds to organize jobs and jobs from the base, not for the costs of collective bargaining or as legal taxes to force workers to federal projects in the fold.
