Imagine a guy who spent 40 years operating excavators and bulldozers. He retires a few years before full retirement age (FRA), applies for Social Security, and sells most of the fleet. She has a backhoe because she can’t let go.

A former customer calls needing it for a weekend. Then a neighbor calls. Then a small contractor wants it for two weeks. The checks are deposited, the machine returns, and soon the phone is ringing often enough that his wife jokes that he never retired.

The joke may have landed closer to the truth than either of them realized. Social Security doesn’t care if you call yourself retired. If these rentals become a trade or business, the resulting net earnings may count as work under the superannuation earnings test.

When a backhoe becomes a business

The IRS and Social Security look beyond the size of the check and the description of a “rent” on the bill. The question is whether it is an occasional transaction of movable property or an activity for profit with continuity and regularity. A single rental to a friend after a flood may still be non-business rental income. A phone that rings most weeks, repeat customers, regular invoices and prices designed to produce a profit start to look like an operation. Neither factor settles the matter. The whole pattern does.

If the activity crosses into business territory, the income and expenses are generally passed on Schedule C. The net profit can then be subject to self-employment tax and count as income for Social Security purposes. A few details can strengthen the business case. You could advertise the backhoe, arrange delivery, fuel and service between rentals or supply an operator. But he doesn’t have to get back into the cabin himself. A trade or business may be carried on through employees or agents.

This is also different from the usual rule for real estate rentals, which are generally excluded from self-employment net earnings unless an exception applies. A backhoe is personal property. Follow a different path. Writing “rent” on the bill doesn’t change anything. The activity decides.

Why post-claim classification is important

Because you claimed Social Security before FRA, the retirement earnings test applies. For someone below this milestone in 2026, Social Security withholds $1 in benefits for every $2 of earnings above $24,480. Non-business rental income from the backhoe may be taxable without becoming net self-employment earnings. However, if the activity reaches the level of a business, its net profit can enter the calculation of the earnings test.

This distinction affects cash flow twice. You may owe self-employment tax on the benefits, and Social Security may withhold benefits if your total covered earnings exceed the annual limit. Retained earnings are not simply lost. When you reach full retirement age, Social Security recalculates your monthly payment to take into account the months in which benefits were withheld. But this subsequent adjustment does not solve the cash shortage today and the self-employment tax is not refunded.

There may also be an eventual upside. Social Security reviews additional covered income, and a profitable rental year could increase your monthly benefit if it replaces a lower year in the 35-year calculation. The same income that breaks the checks today could improve them modestly later.

Decide what business you are actually in

The first step is to document what is happening. You must track every rental, payment, expense, customer, delivery, and hours spent managing or maintaining the machine. These records will help a tax professional determine whether you have occasional rental income or a continuing business.

If you want to keep saying yes every time the phone rings, you’d have to budget for Schedule C reports, possible self-employment tax, and possible withholding of benefits. If you only want a one-time rental, the facts must support that description. Calling a normal operation will not.

He would also need to run the numbers before accepting enough work to exceed the annual earnings limit. Gross rent checks are not necessarily the number that Social Security counts. The relevant number is generally the net earnings after allowable business deductions and the applicable self-employment adjustment.

Two retirees can own identical backhoes and get paid the same amount of money, but get different tax treatment because one completed an isolated lease and the other quietly rebuilt a business. The backhoe never had to put him back in the operator’s seat. Once the rents became regular, the tax return could go back to working on paper.
